By accessing or using BIDShielder, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of service

BIDShielder is a software tool that assists Australian mortgage brokers in creating Best Interests Duty (BID) advice packs. The service uses smart automation to generate draft content based on information you provide. BIDShielder is a compliance assistant, not a legal service.

3. Not legal advice

BIDShielder does not provide legal, financial, or compliance advice. All content generated by the platform is draft material intended to assist you in preparing your own compliance documentation. You are solely responsible for reviewing, editing, and ensuring the accuracy and compliance of all output before use. You should seek independent legal advice for compliance matters.

4. Your responsibilities

  • You are responsible for the accuracy of all information you enter into BIDShielder.
  • You must review and verify all generated content before using it in any professional capacity.
  • You must comply with all applicable Australian laws and regulations, including the National Consumer Credit Protection Act 2009 and the Best Interests Duty obligations.
  • You must not use the service for any unlawful purpose.

5. Account

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised access to your account.

6. Intellectual property

Content you create using BIDShielder belongs to you. The BIDShielder platform, including its design, code, and branding, is our intellectual property. You may not copy, modify, or distribute any part of the platform without our written consent.

7. Limitation of liability

To the maximum extent permitted by law, BIDShielder is provided "as is" without warranty of any kind. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the service. This includes, without limitation, any regulatory action, loss of licence, or financial loss resulting from reliance on generated content.

8. Pricing and billing

Pricing is displayed on our website and may change with 30 days' notice. All prices are in Australian dollars and inclusive of GST where applicable. Subscriptions renew automatically unless cancelled.

9. Termination

You may cancel your account at any time. We may suspend or terminate your access if you breach these terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Changes to terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
